樂高羅燦:我們對中國市場充滿信心

案情回顧:上海警方偵破侵犯“樂高”玩具品牌著作權案

2019年4月23日,上海警方在廣東汕頭、深圳等地警方的配合下,成功摧毀了涉嫌侵犯“樂高”品牌著作權的犯罪團伙——“樂拼”,抓獲以李某為首的4名犯罪嫌疑人,搗毀生產、包裝、倉儲等窩點3處,流水線10余條,繳獲生產模具90余塊,說明書近20萬份,包裝盒20萬余件,成品“樂拼”玩具63萬余件,涉案金額逾2億元。

“樂拼”以營利為目的,未經“樂高”授權擅自予以復制、生產,違法所得數額巨大,已經涉嫌刑事犯罪。目前,該案李某、余某、杜某、閆某等4名犯罪嫌疑人已被依法刑事拘留,案件仍在進一步偵辦中。上海警方成功破獲此案,充分彰顯了公安機關打擊侵犯知識產權犯罪的信心和決心,有力地維護了企業的知識產權和智力成果。

加強知識產權保護 阻止侵權

《法人》:今年4月,上海警方偵破侵犯“樂高”玩具品牌著作權案,摧毀了山寨品牌“樂拼”生產和銷售假冒“樂高”的犯罪鏈條,嚴厲打擊了“樂拼”盜版侵權的違法犯罪行為。關于這個案子,您能分享下感受嗎?

Faren Magazine: In April of this year,Shanghai police had spared no efforts to fight against infringing products constantly. In April, they took actions to stop “LEPIN” from counterfeiting and pirating “LEGO”, to stem “LEPIN” in intellectual property theft. Could you please share more details with us regarding this case?

羅燦:知識產權是樂高集團業務發展的重要基石,因此,我們不遺余力地在中國及全球其他地區加強對樂高商標、版權、設計及專利的保護。對樂高集團而言,確保消費者不會被誤導是非常重要的。消費者購買的樂高產品都符合嚴格的安全和質量標準,這是他們可以并且期望從我們的產品中獲得的。

在知識產權保護中,我們的另一個關注重點是阻止侵權者進行剽竊。我們歡迎公平競爭,但當有人濫用我們的IP時,我們會堅決采取一切必要的法律手段,以保護消費者權益以及我們的品牌權益。

舉個例子,我們已經贏得了針對兩個侵權案山寨品牌“Bela”和“樂拼”的訴訟,法院根據《中華人民共和國著作權法》和《中華人民共和國反不正當競爭法》對案件作出了公正判決。同時,我們也為上海警方在對“樂拼”工廠和倉庫的突擊檢查行動提供了有力支持。

Robin Lynne Smith: Intellectual Property rights and assets are fundamental to the LEGO Group business, and we therefore constantly strive to enforce and protect our LEGO trademarks, copyrights, designs and patents, in China as well as abroad. Among others, we always make sure we keep a strong trademark portfolio and prioritize brand protection to ensure that our consumers are not misled. It’s critically important to us that when our consumers buy a LEGO? set, they get a product of impeccable quality that lives up to the strictest safety standards, which is exactly what they can and should expect from our products.

Another focus area in our IPR protection is to stop copycat infringers who make blatant copies of LEGO products. We welcome fair competition at any time, but when someone misuses our IP, our brand and the consumer’s trust, we take whatever legal action necessary to protect consumers and our rights in our brand. For example, we have been litigating against two major copycat brands Bela and Lepin and received favorable decisions from Chinese Courts under copyright law and anti-unfair competition law. We also supported the Shanghai police on a massive raid action against the factory and warehouses of Lepin infringers.
